Terms of Service

These Terms of Service (“Terms”) govern your use of NurseStudy Prep, the online nursing-education practice service available at prep.nursestudy.net (the “Service”). NurseStudy.Net is a sole proprietorship operated by Anna Curran (“NurseStudy.Net,” “NurseStudy Prep,” “we,” “us,” or “our”). By creating an account, starting a trial, purchasing a subscription, or using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be legally able to enter into these Terms. You are responsible for activity under your account and for maintaining the confidentiality of your login credentials. You must provide accurate account and payment information and promptly update it when it changes.

2. Educational use only

NurseStudy Prep provides digital nursing-education materials, including practice questions, rationales, quizzes, courses, and bonus resources. The Service is for study and educational purposes only. It is not medical, nursing, clinical, legal, career, or other professional advice and does not replace professional judgment, supervision, institutional policies, or applicable law.

We do not guarantee that you will pass the NCLEX or any other examination, receive a license, achieve a particular score, or obtain an academic, clinical, or employment result. NurseStudy.Net is not affiliated with or endorsed by the National Council of State Boards of Nursing or any examination provider.

3. Acceptable use

You may use the Service only for your personal, lawful, noncommercial study. You may not:

share your account or allow another person to use it;
copy, record, scrape, reproduce, distribute, publish, sell, sublicense, or create derivative works from Service content except as permitted by law;
use automated tools to access, collect, copy, or interfere with the Service;
circumvent access controls, subscription limits, or security measures;
use the Service to cheat or violate an institution’s, employer’s, regulator’s, or examination provider’s rules;
upload malware, unlawful content, patient information, or content that infringes another person’s rights; or
use the Service in a way that could damage, disable, overburden, or impair it.

4. Ownership and license

The Service and its content, including questions, explanations, text, graphics, design, software, and trademarks, are owned by or licensed to NurseStudy.Net and protected by applicable law. While your trial or paid subscription is active and you comply with these Terms, we grant you a limited, personal, nonexclusive, nontransferable, nonsublicensable, and revocable right to access and use the Service for personal study.

5. Plans and included content

NurseStudy Prep currently offers a $29 monthly plan and an $80 three-month plan. Both plans provide access to the available question library and every bonus flashcard or study guide made available during the customer’s active subscription. Bonus resources may be added, changed, or removed over time and are not promised in a fixed quantity or on a fixed publication schedule.

6. Two-day trial and automatic renewal

A valid payment method is required to start the two-day free trial. The date and time on which the trial ends and the first charge is scheduled will be displayed at checkout or in the order confirmation.

Unless you cancel before the two-day trial ends, your selected plan automatically converts to a paid subscription. The monthly plan automatically renews at $29 each month. The three-month plan automatically renews at $80 every three months. Recurring charges continue until you cancel.

By selecting a plan and completing checkout, you expressly consent to the trial conversion and recurring charges and authorize Stripe to charge your payment method for the first paid term and each renewal. Prices are in U.S. dollars and may be subject to taxes where required.

Before the order is completed, the checkout will clearly disclose the trial period, first charge, renewal price and frequency, cancellation method, and no-refund policy near the final order button. The checkout will require affirmative consent. We will provide an electronic acknowledgment containing the material subscription and cancellation terms.

We will provide renewal, annual reminder, material-change, and price-change notices when required by applicable law. California customers may cancel online at will without steps that obstruct or delay cancellation.

7. Cancellation

You may cancel future renewal charges at any time through the cancellation control in your customer account. You may also use this pre-addressed cancellation email, which is formatted so you can send the cancellation request without adding information.

To avoid the first paid charge, cancel before the trial ends. To avoid a renewal charge, cancel before the next renewal date shown in your account or confirmation. Cancellation stops future renewal charges. If you cancel during a paid term, access continues through the end of that paid term unless we state otherwise or applicable law requires a different result.

8. No-refund policy

Because the Service provides immediate access to digital educational content, subscription charges are final and nonrefundable, including charges for monthly terms, three-month terms, renewals, partial periods, unused time, or unused content. We do not provide prorated refunds. This policy does not limit rights that cannot legally be waived. See our No-Refund and Cancellation Policy.

9. Service availability and changes

We may update, add, change, suspend, or discontinue content or features. We will use reasonable efforts to operate the Service, but we do not promise uninterrupted, error-free, or completely secure availability or compatibility with every device or browser.

10. Suspension or termination

We may suspend or terminate access if we reasonably believe you violated these Terms, created legal or security risk, failed to pay an amount due, shared access, copied content, or misused the Service. Provisions that by their nature should survive termination will remain in effect.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” NURSESTUDY.NET DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NURSESTUDY.NET, ANNA CURRAN, AND THEIR SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE LIMITED.

13. Governing law and disputes

These Terms are governed by California law, without regard to conflict-of-law principles. Subject to any nonwaivable consumer rights and any claim eligible for small-claims court, disputes will be brought in the state or federal courts located in San Diego County, California.

14. Changes to these Terms

We may update these Terms prospectively. We will post the updated version and revise the effective date. We will provide additional notice and obtain consent when required by law.
